Welcome to Codespect ("we", "our", "us"). By accessing or using our service (the "Service"), you agree to comply with and be bound by the following terms and conditions (the "Terms"). Please read them carefully. If you do not agree to these Terms, you must not use the Service.

1. Acceptance of Terms

   By creating an account, accessing, or using our Service, you agree to these Terms of Service and our Privacy Policy. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Modifications to Terms

   We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated version on our website. Your continued use of the Service after the changes indicates your acceptance of the new Terms.

3. Eligibility

   You must be at least 18 years old to use our Service. By using our Service, you represent that you meet this eligibility requirement.

4. User Accounts

   To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account and password and accept responsibility for all activities that occur under your account.

5. Use of the Service

   You agree to use the Service for lawful purposes only. You agree not to:

   • Violate any laws or regulations.
   • Interfere with or disrupt the Service or servers/networks connected to the Service.
   • Transmit any viruses, malware, or harmful content.
   • Attempt to gain unauthorized access to any part of the Service.

6. Data Handling and Repository Usage

   • No Code Storage or Modification: Our application does not store or modify any source code from your connected repositories. We will not alter, edit, or push changes to your connected repositories.
   • Storage of Pull Request Diffs: We only store the diff from Pull Requests for analytical purposes. This allows us to evaluate the quality of the code changes, but no full source files are stored.
   • AI Processing and Data Transmission: Our current AI model is ChatGPT, provided by OpenAI. By creating an account and using our Service, you also agree to OpenAI's Terms of Use, available at OpenAI Terms of Use. Our application only sends the diff from Pull Requests to ChatGPT for analysis and does not send any full source files or repository data.

7. GitHub Account Authorization

   By connecting your GitHub account to our Service, you represent and warrant that you have full authorization and legal rights to connect and use the associated repositories with our Service. You are responsible for ensuring that your usage complies with any agreements or regulations related to your GitHub account and repositories.

8. Intellectual Property

   All content, design, logos, and software associated with the Service are the intellectual property of Codespect or its licensors. You agree not to reproduce, modify, or distribute any part of the Service without prior written permission.

9. Fees and Payments

   Access to some features of our Service may require payment. You agree to pay all applicable fees as specified when you sign up for a paid service. We reserve the right to change our pricing at any time. Payments are non-refundable unless otherwise stated in these Terms.

10. Termination

    We reserve the right to suspend or terminate your access to the Service at any time for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Service will cease immediately.

11. Disclaimer of Warranties

    The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components.

12. Limitation of Liability

    To the fullest extent permitted by law, Codespect shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the Service.

13. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of Poland. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Szczecin, Poland.
